Chapter 13 Bankruptcy — Keep What You Have. Pay What You Can.

Chapter 13 lets you restructure your debt into a manageable repayment plan — and keep your home, your car, and your financial footing.

What Is Chapter 13 Bankruptcy?

Chapter 13 is a reorganization bankruptcy. Rather than discharging debt immediately, it allows you to propose a structured repayment plan — typically three to five years — during which you pay back some or all of what you owe based on what you can actually afford. At the end of the plan, remaining eligible debts are discharged.

Chapter 13 is often the right choice for people who have regular income, want to keep assets they might otherwise lose, or need to catch up on mortgage arrears to avoid foreclosure.

How the Process Works

STEP 1

Filing and the Automatic Stay

The moment you file Chapter 13, an automatic stay takes effect. Creditor calls stop. Garnishments stop. Foreclosure proceedings are halted. This protection begins immediately upon filing.

STEP 2

The Repayment Plan

We work with you to develop a repayment plan based on your income, expenses, and the types of debt you owe. The plan is submitted to the court for approval. Most plans run five years, though some clients qualify for a three-year plan depending on income and the bankruptcy district.

STEP 3

Completion and Discharge

Once you complete your repayment plan, remaining eligible debts are discharged. You emerge with a clean slate — and, in many cases, having kept property you would have lost in a Chapter 7.

Experience Makes a Difference in Plan Structure

The structure of your repayment plan matters enormously. A well-structured Chapter 13 plan can mean the difference between a monthly payment you can sustain for five years and one that puts you back in financial trouble. At Whitford & Owen, we have structured hundreds of Chapter 13 plans across Kentucky and have extensive experience navigating the plan confirmation process. We use that experience to build the most affordable plan your situation allows.

Situations Where Chapter 13 Is the Stronger Option

Chapter 13 gives you tools that Chapter 7 simply does not. Here are the situations where it makes the biggest difference.

Save Your Home From Foreclosure

If you’re behind on your mortgage, Chapter 13 allows you to catch up on arrears over the life of your repayment plan while continuing to make current payments. This is one of the most powerful tools available to homeowners facing foreclosure.

Restructure a Car Loan

This is one of the most valuable — and least known — benefits of Chapter 13. In many cases, we can restructure your car loan so that you pay only what the vehicle is actually worth, not what you originally borrowed. If you owe $18,000 on a car worth $10,000, Chapter 13 may allow you to reduce the loan balance to the car’s current value. And because the bankruptcy court sets the interest rate on the restructured loan, clients who took out high-interest financing often see their rate reduced significantly as well.

Protect Assets You Might Otherwise Lose

If you have assets that could be at risk in a Chapter 7 — such as a second vehicle or significant equity in property — Chapter 13 lets you keep them while paying creditors through the plan.

Handle Debts That Can’t Be Discharged Immediately

Certain debts — like recent tax obligations or mortgage arrears — can be managed and paid off through a Chapter 13 plan in a structured, manageable way.

What About My Credit?

Your credit can begin recovering sooner than most people expect. Individual debts fall off your credit report when you file, which often offsets the impact of the bankruptcy notation itself.

Chapter 13 filers can become eligible for an FHA mortgage just one year after the filing date — provided they’ve maintained a satisfactory payment record in their plan and meet other standard lending requirements. That’s faster than most people realize.

Is Chapter 13 Right for You?

Most people who call us aren’t sure which type of bankruptcy fits their situation — and that’s completely normal. Bankruptcy comes in several forms, and the right choice depends on your income, your assets, your goals, and the types of debt you’re carrying.

Some people are better served by a process that eliminates debt quickly; others need a structured plan that lets them catch up on a mortgage or keep a vehicle they couldn’t protect otherwise. That’s exactly what the free consultation is for. We’ll look at your full picture and give you an honest recommendation based on your specific situation.
